Proposed Election 2012 Caucus Resolutions for Judicial Reform (updated & expanded) Part 2 of 2

Collectively, these Resolutions call for Judicial TAR reform Legislation. (Transparency, Accountability and Reform)

PROPOSED RESOLUTION 17

Whereas,

1)      SIMULATED LITIGATION AND FACT SHAPING SHOULD BE CRIMINALIZED;
2)      Many Judges have abandoned judgments based on the Rule of Law applied to the impartially entered facts in evidence;
3)      One form of simulated litigation and Fact Shaping, the Judge telegraphs and/or otherwise communicates to the litigant’s attorneys what result the court desires. The lawyers then put facts in evidence or prevent facts from being put into evidence in such a matter to allow the judge to make their desired judgment. This duplicitous technique gives the appearance that the judge is making the decision the judge indicated they wanted, when in fact the “facts in evidence” have been shaped and manipulated to allow that judgment. In effect the appearance of justice while being absolutely unjust.

THEREFORE, BE IT RESOLVED THAT THE PLATFORM SHOULD BE INCORPORATED TO REFLECT THE FOLLOWING:

1) WE THE PEOPLE command our elected officials to draft legislation codifying and criminalize all forms of simulated litigation and fact shaping.

1)      The Founding Fathers believed Elections to be good method to assure accountability;
2)      The Federalist papers referred to the judicial branch as the weakest branch: http://bit.ly/xMG5kd ;
3)      Thomas Jefferson later said:

“At the establishment of our constitutions, the judiciary bodies were supposed to be the most helpless and harmless members of the government. Experience, however, soon showed in what way they were to become the most dangerous; that the insufficiency of the means provided for their removal gave them a freehold and irresponsibility in office; that their decisions, seeming to concern individual suitors only, pass silent and unheeded by the public at large; that these decisions, nevertheless, become law by precedent, sapping, by little and little, the foundations of the constitution, and working its change by construction, before any one has perceived that that invisible and helpless worm has been busily employed in consuming its substance. In truth, man is not made to be trusted for life, if secured against all liability to account.”

Do not separate text from historical background. If you do, you will have perverted and subverted the Constitution, which can only end in a distorted, bastardized form of illegitimate government."

5) The Federal and State Judiciaries have become systemically corrupt and overly powerful to the point of tyranny.

THEREFORE, BE IT RESOLVED THAT THE PLATFORM SHOULD BE INCORPORATED TO REFLECT THE FOLLOWING:

1)      A series of reforms is necessary to restore the balance of power in the system of checks, balances, transparency and accountability in the three branches of government as the Founding Fathers intended;
2)      The First of these reforms to be that all Federal and State judges are to be duly elected;
3)      The Next of these reforms to be TERM LIMITS:
4)      All Federal and State District Court Judges may serve two 4 year terms;
5)      All Federal and State Appellate Court Judges may serve an additional two 4 year terms;
6)      All Federal and Appellate court Chief Justices may serve an additional one 4 year term;
7)      All Federal and State Supreme Court judges may serve an additional two 4 year terms;
8)      All Federal and State Supreme Chief Justices may serve an additional two 4 year terms;
9)      All interim appointments shall be temporary and the temporary replacement may not run for the seat the temporarily fill at the next election for that seat.

COMMENTARY

The judicial system has betrayed the trust of WE THE PEOPLE. The Judiciary may blame their poor and unconstitutional judgments which they felt comfortable in rendering. The current methods of appointing and electing judges has failed to protect they best interests of WE THE PEOPLE because judges lacked accountability and the judges were not able to exercise self-control in the absence of accountability to WE THE PEOPLE.

PROPOSED RESOLUTION 19

Whereas,

1)      Judges currently enjoy a RULE OF JUDICIAL IMMUNITY;
2)      Judges were endowed with judicial immunity to prevent and avoid them from being harassed with baseless, retaliatory actions and litigation. In good faith, Judges were trusted to act honorably;
3)      With severely limited consequences for behaving badly, Judges have been unable to restrain themselves as result of this “absolute power”;
4)      Thomas Jefferson later said:

It is more important to protect 300 million rank and file Americans from corrupt Judges than it is to protect corrupt judges from citizens with legitimate grievances.

Pirates of Publicly Funding the Minnesota Vikings Stadium

(In other States this should be titled – Pirates of Public Funding of Professional Sports Stadiums)

Having heard some of the criticism of his position on the public financing of professional sports, this author presents his peremptory qualifications as a football fan.

1)      In Elementary school, when whether permitted recess was roughly evenly divided between school yard foot ball and deer tag;
2)      In Junior High, during summer vacation, this author broke his hip playing sandlot football;
3)      In Senior High, this author played on the High School Football Team;
4)      In College, this author played intramural football;
5)      This author was affiliated with certain undisclosed parties that smuggled kegs into Golden Gopher football games at Memorial Stadium during college;
6)      If the this author had grown up in Minnesota, he would be a Vikings Fan;
7)      If The ViQueens had had a winning team when this author first came from Wisconsin to Minnesota for College, he would now be a Vikings fan instead of remaining a Packer fan.

Those were my thoughts.

Proposed Election 2012 Caucus Resolutions for Judicial Reform (updated & expanded) Part 1of 2

This is a list of proposed 2012 Caucus resolutions for judicial reform. For Rank and File Americans, Party affiliation will not be a concern in endorsing these proposed resolutions. Collectively, these Resolutions call for Judicial TAR reform Legislation. (Transparency, Accountability and Reform)

We encourage you to reprint these and take them to your upcoming caucus and/or District, State and National conventions.

If your caucus has not already been held, please present any and/or all of these proposals that you agree with at your precinct caucus. (Even if you live in a primary state, there is still a caucus) If you precinct caucuses have already been held, please contact your delegates selected for the District, State and National
Conventions and ask them to submit these resolutions at that level. If you are a delegate to the District, State or Federal Convention for your party, please submit and/or support these resolutions at that level.

Again, this author believes these resolutions to be non-partisan in nature, yet essential to reestablish the role that Natural Law, the Constitution, the Bill of Rights and the Rule of Law in our currently systemically corrupt state and federal judiciaries.

At the same time, some of these proposed resolutions may not apply to your state, depending on the level of corruption that has encroached on justice in your locality. While this author will try to point out resolutions that may not be applicable to states other than Minnesota, please review each resolution for applicability to your state. Again, the progression of judicial corruption in your state may not have reached the systemic corruption in Minnesota, and therefore certain of these judicial reform platform resolutions may not be applicable to your state.

Most of these resolutions are the result of the culmination of the work of hundreds of Minnesota Citizens attempting to exercise our Constitutional 1st Amendment Right to Petition the Government for Redress of grievances for the past 7 or more years. (The Minnesota State House and Senate Judiciary Committees for 7 years have refused to allow 100’s of Minnesota Citizens a hearing to provide evidence and testimony of corruption in the Minnesota Courts.) This is this author’s “Plan B” to forcing Judicial Reform. Some of the resolutions contain links to the historic or logical explanation for the proposed resolution. If you are so motivated, rally or friends and neighbors (or other delegates at District, State and Federal Conventions) to go to your precinct caucus to press this agenda. Be prepared to hear at the beginning of District Conventions various motions to limit debate to save time. (The reality being that the status quo entrenched delegates and the political parties themselves do not want change; they want the status quo. Be prepared for resistance to these resolutions from those who benefit from the current corrupt system.)
Each of these resolutions should be able to be submitted to your caucus and/or convention as is. Some of the Minnesota Specific proposed resolutions may be adaptable to your state with simple language changes. PROPOSED RESOLUTION 1

Whereas,

Judicial decisions should be based on the Rule of Law based on the facts in evidence;
Instead, justice in American is more a matter of “How much justice can you afford?” who you know, who you can influence and/or exchange of political favors with, punishment of lawful political dissent, reward for political loyalty and the Whim of Judges. Citizens should be able to come to before the Courts and have a full, fair, impartial and just adjudication of their cases.

THEREFORE, BE IT RESOLVED THAT LANGUAGE SHOULD BE INCORPORATED INTO OUR PARTY PLATFORM TO REFLECT THE FOLLOWING:

1) Judicial Decisions must be based on Natural Law and the Rule of Law applied to the facts freely admitted in evidence;

PROPOSED RESOLUTION 2

Whereas,

1)      The legal profession was necessary at the beginning of the Country;
2)      But literacy rates have improved such that most high school graduates could represent them selves in most matters if the laws, court rules and case law were written plainly and in simple English;
3)      Lawyers often do not treat their clients ethically and current use the laws and rules to the disadvantage of their own clients;
4)      Lawyers are so expensive as to prohibit many people from hiring one;
5)      Straight forward, simple English laws and court rules compiled and collated in a few documents would allow rank and file Americans to better represent themselves and better understand the process even when they are represented by a lawyer;
6)      The current amalgam of Court rules, Case Law and Legislation are unnecessarily complex and confusing;
7)      The scattered nature of Court Rules and Case Law yields great unnecessary expense to rank and file Americans who have to pay attorneys who say they “research” the legal nuances;
8)      Case Law is full of unresolved conflicting rulings on the same subject;
9)      Case Law Conflicts allow Judges to Cite 1 Case Law Citation in one case and a difference citation in a same/similar but different case with wildly difference outcomes. This defies the intention of the “Rule of Law”.

THEREFORE, BE IT RESOLVED THAT LANGUAGE SHOULD BE INCORPORATED INTO OUR PARTYPLATFORM TO REFLECT THE FOLLOWING:

1)      That the entire legal code, court rules and case law be written in simple English so that Citizens with a high school degree that can represent themselves;
2)      That the Legislature of the State is required to undertake this task immediately and resolve all conflicts in cases law in so doing;
3)      That thereafter, every 10 years, the Legislature will meet to incorporate all interim case law in the code and resolve all conflicting case law rulings;
4)      WE THE PEOPLE propose that all State and Federal Court Rules, Case Law and Legislation be logically laid out in 5 documents:

A)     Federal Criminal Code
B)     Federal Civil Code
C)     State Criminal Code
D)     State Civil Code
E)      State Family Code

PROPOSED RESOLUTION 3

Whereas,

1)      The Natural Law Right to own Property is affirmed by the Constitution and Bill of Rights;
2)      The Condemnation of Private Property (takings) for Public Use as narrowly defined in the Constitution and 5th Amendment has been interpreted in an unconstitutional way by the US Courts;
3)      Essentially the US Courts have ruled that Government can act as kings and take property from one private property owner and give it to another private Property Ruler;
4)      These Court Rulings essentially reestablish our government philosophy as “The Divine Right of Kings;
5)      The Courts have ruled that the Government can condemn one citizens private property and give it to another private citizen or business;
6)      The Courts have ruled that Citizens cannot drink milk from a cow that they own all or party of;
7)      The United Nations Agenda 21 is yet another reassertion of the Divine Right of Kings upon WE THE PEOPLE;

THEREFORE, BE IT RESOLVED THAT LANGUAGE SHOULD BE INCORPORATED INTO OUR PARTY PLATFORM TO REFLECT THE FOLLOWING:

1) Our State and Federal Legislatures shall pass legislation condemning the property right power grab by the US Courts;
2) Said Legislation shall restore “Public Use” to it original narrow intent of the Founders.

4) JUDICIAL TRANSPARENCY, ACCOUNTABILITY AND REFORM (Continued)

RIGHT TO CRITICIZE JUDGES/PROHIBITION OF RETALIATION

Judges often retaliate when criticized. This candidate himself has experience said retaliation for criticizing the Minnesota Judiciary.

The Right to Free Speech is Sacred in America. The Right to criticize the government without reprisal is a hallmark requirement of a Representative Republic. Yet judges often fine, sanction, jail, fix cases against and otherwise retaliate against citizens, lawyers and other government officials who would dare criticize.
It is in the interest of free speech, transparency and accountability that this Candidate for president indicates he would pursue legislation to remedy, restrict and criminalize this retaliation.

DUPLICITOUS USES OF THE COURTS

The Courts are used to punish voices of political dissent. Findings and Judgments not consistent with the Rule of Law are used to give adverse rulings to those who are Leaders or otherwise vocal in their political dissent of the government.

The Courts are used to marginalize political opponents. Again, think Rulings or the Delay of rulings inconsistent with the Rule of Law.

The Courts are used to exact personal grudges of judges and their friends. ibid

The Courts are used to fulfill commitments for gifts otherwise known as bribes. Ibid

The Congress has the Judiciary make laws as a matter of case law, so Congress does not have to face the fallout at election time. Since, most Federal Judges are appointed and not elected; they are insulated from electoral retribution by WE THE PEOPLE.

As president, besides the Transparency, Accountability and Reform expressed elsewhere in this document, I will pursue other measures to assure all citizens that come before the Courts receive justice in accordance to the Rule of Law applied to the impartially admitted facts in evidence.

SUPREME AND/OR APPELLATE COURT REFUSAL TO HEAR APPEAL

Because the Judicial and Legal System of the United States has become systemically corrupt, there is a necessity of greater transparency and accountability.

An area that has been alleged to be a point of abuse is the rejection of appeals without explanation. Ergo, WE THE PEOPLE have no idea of the rejection was done pursuant to the Rule of Law or some other unethical, illegal, unconstitutional reason.

As President, I would press legislation requiring all appeals that Federal and State, Supreme and/or Appellate Courts refuse to hear shall be provided with at least a one page explanation (Not including headers).
If reason for denying an appeal is a simple, correctable deficiency or error, the court shall provide a simple explanation of how to correct the deficiency or error and grant 30 days to fix the error or deficiency.
Otherwise, if historic legitimate reasons fall into 5-10 categories, a form with check boxes can be used and a 3-4 sentence summary of the rejection would suffice.

And of course it would have to contain the certification language discussed under a previous heading.
As president, I would pursue these reforms.

5) CITIZENS ANTI-CORRUPTION COMMITTEE

As President I would vigorously seek to set up a Citizen’s Anti-Corruption Committee consisting of 50 randomly selected citizens. 1 from each state.

The first requirements would be at least a high school diploma and no felony convictions.

Secondly, the individual will not have held elected office or worked for the government and promises not to hold elected office or work for the government for the rest of their lives.

Thirdly, these persons would agree to make all of their personal and 1st degree relatives finances public for the 1 year before taking office, during all years served on the committee and for 20 years after said service. In exchange for making their finances public, the committee member will get $10,000 for each year of compliance and their 1st degree relatives will get $5000.00 per year. The contractual obligation to maintain their finances as public shall be irrevocable once the any recipient has accepted one or more payments. (unless they are convicted of a felony)

These citizens shall be given a budget and authority to investigate ant part of Federal or State Government (Any office, branch, county, city, school, police, judge, president, dog catcher, etc) they so desire. They can get search warrants, wire taps etc using the same standards that apply to law enforcement.

Elected officials and Government Bureaucrats shall be noticed that they are employees and have no expectation of privacy in using government property or property paid for by the government.

This Anti-Corruption Committee can present their findings directly to any appropriate Grand Jury, Congress, Federal District Court or State Legislature. Or, they can request advice and assistance from the appropriate Federal, State or County Attorneys. Failure of any Government Attorney to give timely and correct assistance to this committee shall be considered treason and punishable as such....

Ron Paul – Texan Vote’m: After kicking the tires, this voter is “All In”

PROLOGUE

Quite simply, we are going to have some fun exposing the “Con Job” that our American elections have become. Together we are going to make common sense out of the deliberate confusion that the 2 major political parties and major media have created around previous elections. By the end of our conversation, you should realize that you should simply cast your vote in accordance with your own “best interests”. Hopefully, you will realize that this is less my endorsement of Ron Paul than it is your very own endorsement of Ron Paul. And we will accomplish all of this in 12 fun and easily understood sections:

Recently I heard that Donald Trump was endorsing Mitt Romney. And I thought to myself, so what? Donald Trump is most likely going to endorse a candidate that embraces the concerns of millionaires and reality show executives. I am neither a millionaire nor a reality show executive. So, why do I care who Donald Trump endorses? Donald Trump, as far as I am concerned, you and your endorsement are fired!

But for some reason, the major media considers Donald Trump’s endorsement newsworthy. Perhaps the major media thinks this next presidential election should be like a Junior High Student Council election – A simple popularity contest with few consequences for choosing poorly? I don’t share that perspective.

And then I thought; perhaps the major media and the political parties have framed and confused the elections in such a way that the candidate a person should select to vote for is not obvious. Perhaps the average American is not aware that the propaganda techniques of Edward Bernays are being used upon them to subvert their individual will? (I often advise my fellow citizens that they can't protect themselves, their perspective of reality nor their family from our Government if they don't know about Edward Bernays http://bit.ly/nY9BjW)

Along those lines, my thoughts go to those frazzled rank and file Americans who are busy raising their families and earning money to pay taxes.

Further, I am concerned for the newest voters who may not know the “ins and outs” of “kicking the tires” on their first presidential election.

And I am also concerned for our more Seasoned Citizens that dutifully contributed to Social Security and other programs but were lied to by the politicians who frittered away the funds that were supposed to be in the lockbox.

WHY YOU MUST GO TO YOUR CAUCUS THIS YEAR!

But the reality is that the day after the election, our elected officials and political parties sell their votes to the highest bidder. Our elected official’s votes are not cast in the best interests of their constituents but rather based on who gives the biggest campaign contributions and/or kickbacks…

Our Elected no longer are content to represent WE THE PEOPLE. They now want to manage, manipulate and fleece us like livestock.
